Sidecar Social NOLA Trip Giveaway - Official Rules
Sidecar Social organizes and sponsors promotions, giveaways, and contests awarding various prizes to participants. The promotions, giveaways, and contests are regulated by Contest Rules (hereinafter “Rules”). Participation in any of these contests constitutes the Participant’s agreement and acceptance of these Rules. All federal, state, local, municipal laws and regulations apply.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR CONTRIBUTION TO SIDECR SOCIAL WILL NOT INCREASE YOUR CHANCES OF WINNING.
How to Enter: Visit the sweepstakes table at Sidecar Social during the Contest Period, take a photo with the Sidecar Backdrop and post the photo to one or more of your social media platforms including a location tag at Sidecar Social. You will receive an entry form to fill out when you show the table attendant that you’ve posted the image on social media. Eligibility may be checked by the attendant at the time of entry.
Limit one (1) entry per person permitted. All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Only fully completed timely entry forms are eligible ("Eligible Entries"). Proof of submission will not be deemed to be proof of receipt by Sponsor.
All entries made in violation of these rules will be disqualified. By participating in the Sweepstakes, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects.
Disclaimer of Responsibility: Sidecar Social is not responsible for problems with Contest entries, including but not limited to, entries which are lost, late, misdirected, damaged, incomplete, illegible, or cannot be completed due to electronic or technical difficulties, even if the problem is the result of the sole or partial negligence of Sidecar Social.
Contest Period: Entry forms will be accepted starting at 5pm CST on Tuesday, February 25th, 2020 and will not be accepted after 8pm CST. Entry time may also be determined by the band’s performance and could be delayed. Entries submitted before or after the Contest Period will not be accepted into the drawing.
Eligibility: Participation open only to legal residents of Texas who are at least 21 years of age at the date of entry. Void outside of the Eligible Jurisdictions, and where prohibited or restricted by law. Employees of Sidecar Social, their parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies and their respective employees, manufacturers or distributors of Sweepstakes materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter. Sweepstakes may only be entered in or from the Eligible Jurisdictions, and entries originating from any other jurisdiction are not eligible for entry. You are not authorized to participate in the Sweepstakes if you are not located within the Eligible Jurisdictions. All federal, state and local laws and regulations apply.
Winner Selection and Notification Winner will be selected by random drawing, under the supervision of Sidecar Social. Winner will be informed about the prize in person, following the Winner selection to claim the prize. Sidecar Social is not responsible if the Winner fails to receive the notice about the prize due to their lack of attendance at time of drawing. If the Winner fails to respond within the required time period, the prize may be forfeited and an alternate Winner may be selected based on the aforementioned judging criteria. Acceptance of the prize given in this Contest is in accordance with any and all federal, state, and local laws and regulations. If the Winner is disqualified for any reason, Sidecar Social is not obliged to provide an alternate prize or extend the Contest Period in any way, and all privileges as Winner will be terminated immediately. Participants who provide false, fraudulent or deceptive entries or who engage in false, fraudulent or deceptive acts in connection with the Contest will be disqualified and subject to criminal prosecution.
Grand Prize: One (1) Grand Prize Trip for Two (2) to New Orleans, LA for 3 days and 2 nights given in the form of gift cards (“Trip Package”). Trip Package includes: (a) Round trip flight for two on airline of Sponsor's choice (b) two night stay in hotel of Sponsor's choice (one (1) room, double occupancy); (c) $500 spending cash (VISA gift card). Approximate retail value of Grand Prize: $2,500.
Grand Prize Winners will receive a Form 1099 from Administrator for the total value of prize. Prize is non-transferable. No substitutions or cash redemptions. In the case of unavailability of prize, Sponsor reserves the right to substitute a prize of equal or greater value, including in Sponsor's sole discretion, a different travel location. Taxes (including all federal, state and local taxes), meals, gratuities, travel upgrades, or any other expenses not specifically listed herein are the responsibility of Grand Prize Winners.
Additional Details regarding Grand Prize: Travel must take place before August 31, 2020 and booked by March 31, 2020. Travel and accommodations must subject to availability; certain restrictions and blackout dates may apply. If Grand Prize Winner declines to participate in any component of the prize package, that portion shall be forfeited and no substitute component shall be provided. Sponsor is not liable for delays, cancellation or unforeseen events related to the flights. Grand Prize Winner and travel companion will be solely responsible for obtaining all required travel documents, including, but not limited to valid identification, passports and visas relating to acceptance and use of the travel prize packages. Travel companion will be required to sign a Liability and Publicity release (unless prohibited by law) prior to being issued travel documents. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Actual value of prize may vary. Grand Prize Winner will not receive difference between actual and approximate retail value.
All expenses and incidental travel costs not expressly stated in the prize description above, including but not limited to, ground transportation, including ground transportation to and from restaurant, meals, incidentals, gratuities, service charges or facility charges, personal charges at lodging, taxes or other expenses are the responsibility solely of winner. Grand Prize Winner will be required to provide a credit card to hotel to cover incidentals which are not included in prize package. Sponsor not responsible for changes in schedule of any element of the prize or any expenses incurred as a consequence of flight cancellation or delay. Sponsor will not have any liability if the Grand Prize Winner or travel companion for any reason is not permitted to travel by relevant airport authorities or misses a flight or other travel element. Grand Prize Winner and travel companion understand that there are inherent risks involved in travel and that these risks may be present before, during and after the trip.
BY ACCEPTING A PRIZE, WINNER ACKNOWLEDGES A COMPLETE UNDERSTANDING OF THE RISKS INVOLVED WITH THE PRIZE AND IN PARTICIPATING AND ENGAGING IN THE ACTIVITIES ASSOCIATED THEREWITH, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, DEATH, ILLNESS OR ACCIDENT. WINNER ALSO UNDERSTANDS THAT THE RELEASED ENTITIES (DEFINED BELOW) HAVE NOT AND WILL NOT OBTAIN OR PROVIDE INSURANCE OF ANY KIND RELATING TO THE PRIZE AND THAT WINNER WILL BE RESPONSIBLE FOR OBTAINING AND PAYING FOR ANY FORM OF INSURANCE RELATING TO THE PRIZE, INCLUDING ANY LIFE, TRAVEL, ACCIDENT, PROPERTY OR OTHER INSURANCE RELATIVE TO WINNER’S USE OF THE PRIZE.
Release: Participation in Sweepstakes and acceptance of prize constitutes each Grand Prize Winner’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information and/or any statements made by each Grand Prize Winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law.
By participating, entrants and winner(s) agree to release and hold harmless Sponsor and their affiliates, partners and promotion and advertising agencies and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Entities”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy. Sponsor is not responsible if Sweepstakes cannot take place or if the prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism or any other cause beyond Sponsor’s reasonable control. Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way shall be disqualified.
Additional Terms:Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
Limitation of Liability; Disclaimer of Warranties: IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THE SWEEPSTAKES, ACCESSING ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. Disputes; Governing Law: The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the County of Dallas in the State of Texas.
THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to County of Dallas in the State of Texas. The parties agree not to raise the defense of forum non conveniens.
Use of Data: Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy online. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
